These Terms of Service (“Terms”) govern your use of the websites, products, and services (the “Services”) provided by Inciple LLC (“Inciple,” “we,” “us”). By using the Services, you agree to these Terms.

1) Eligibility & your responsibilities

You must be at least 18 years old (or the age of majority where you live) to use the Services. You agree to use the Services lawfully and not to misuse, disrupt, or attempt unauthorized access to the Services. If you create an account, you are responsible for keeping your credentials secure and for activity under your account.

2) User content

You may provide information or requests through the Services (“User Content”). You keep ownership of your User Content. You give Inciple permission to use your User Content only as needed to operate, provide, and improve the Services. You confirm you have the rights to provide User Content.

3) Communications (SMS & Email)

If you opt in, Inciple may send user-requested informational SMS messages and/or emails based on your selections or requests (e.g., updates, alerts, or information you ask us to send). We do not send marketing/promotional SMS through this opt-in.

Email: You may opt out at any time via the unsubscribe link in emails (when provided).

4) Privacy

Our Privacy Policy explains how we collect and use information. It is part of these Terms.

5) Disclaimers

The Services are provided “as is” and “as available.” Inciple makes no warranties (express or implied) and does not guarantee the Services will be uninterrupted, error-free, or secure.

6) Limitation of liability

To the maximum extent allowed by law, Inciple is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Inciple’s total liability for any claim relating to the Services will not exceed the amount you paid to Inciple for the Services in the 12 months before the event giving rise to the claim (or $100 if you paid nothing).

7) Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if needed to protect the Services or users.

8) Changes

We may update these Terms from time to time. The “Last updated” date will reflect changes. Continued use means you accept the updated Terms.

9) Governing law

These Terms are governed by the laws of Delaware, and disputes will be handled exclusively in courts located in State of Delaware.
